2 October, 2010. Regional public organization «Human being and Law» learned that the Russian Federation offered a settlement agreement to Boris Rzhavin. It is evidenced by a memorandum of the Representative of the Russian Federation at the European Court of Human Rights in the case “Rzhavin against Russia”. MEMORANDUM RZHAVIN AGAINST RUSSIA
In its response to the European Court of Human Rights the Russian Federation recognized that in the case of Boris Rzhavin there is a fact of human rights violations by state authorities of the Republic of Mari El who have committed a violation of Article 3, Article 5 p.1 and Article 13 of the Convention on the Protection of Human Rights and Fundamental Freedoms.
Boris Rzhavin applied to Regional public organization «Human being and Law» in 2001. A chairwoman of the organization Irina Simakova personally took all the documents and she was the first who heard this horrible story. In one of the frosty December nights elderly man was forcibly taken to the Zarechniy police department in his underwear and barefoot. The reason for this was a complaint of the man’s niece, who somehow decided that it was he who broke the glass in her house.
The staff members of RPO «Human being and Law» have rendered legal support to Boris Rzhavin since 2001 year. It’s amazing that a man of his age found the strength to defend his rights for nine years. However, this has not led to any result. The investigation was stopped. Human rights activists had no choice but to file a complaint to the European Court of Human Rights.
In December, 2006 Representation of the Interregional Committee Against Torture under Regional public organization “Human being and Law” started its work on the territory of the Republic of Mari El. In accordance with the fact that staff members of the Representation are specialized in the facts of police abuse, the case of Boris Rzhavin was transferred to lawyers of the Representation, who helped to submit a complaint to the European Court of Human Rights.
